Terms of Service

1. Acceptance

By accessing www.motoks.com you agree to these terms. If you do not agree, please do not use the site. These terms apply alongside any written quotation, proforma invoice or contract we issue for a specific order; in case of conflict, the signed contract prevails.

2. Permitted use of the website

• You may browse, download catalogs and submit enquiries for legitimate business purposes.
• You may not scrape the site at a rate that degrades service, attempt to access administrative areas, probe for vulnerabilities, or upload malicious code.
• Product images, specifications and catalog files may be shared with your own customers and colleagues for evaluation, but may not be republished as your own catalog or used to misrepresent the origin of goods.

3. Product information and availability

Specifications, fitment lists, images and dimensions are provided in good faith for reference. Small tolerances in dimensions, colour and finish are normal in manufacturing. Fitment guidance is a recommendation only — the buyer is responsible for confirming compatibility with the target vehicle before ordering.

Because we also produce OEM/ODM parts for other customers, some references may be subject to minimum quantities or tooling requirements. Availability is confirmed in the quotation, not on the website.

4. Quotations, prices and orders

Prices shown or quoted are in the currency stated, EXW or FOB as indicated, and exclude duties, taxes and destination charges unless stated otherwise. Quotations are valid for 30 days unless a different period is stated, and are subject to raw-material and freight movements beyond our control.

An order becomes binding only when we confirm it in writing (order confirmation or proforma invoice) and, where required, receive the agreed deposit.

5. Payment

Standard terms are 30% deposit with balance before shipment, unless otherwise agreed in writing. Bank charges are borne by the payer. Goods remain our property until payment is received in full; risk passes according to the agreed Incoterm.

6. Packing, shipping and documents

We pack for export and provide commercial invoice, packing list and the transport documents required by the agreed Incoterm. Delivery dates are estimates based on current capacity; delays caused by force majeure, customs inspection, carrier congestion or documentation issues are outside our control, though we will keep you informed and help mitigate.

7. Inspection, returns and warranty

Please inspect goods on arrival and notify us in writing within 15 days of receipt of any shortage, damage or apparent defect, with photos and packing-list references. Confirmed manufacturing defects are replaced or credited at our option.

Warranty covers manufacturing defects for 12 months from shipment and does not cover normal wear (brake pads, clutch friction material), incorrect installation, modification, accident damage, or use beyond the stated specification. Consumable items are excluded.

8. Intellectual property

The MOTOKS name, logo, catalog layout and website content are our property. Third-party trademarks, vehicle brands and model designations mentioned on this site belong to their owners.

For OEM/ODM projects, tooling, drawings and specifications paid for by the customer remain the customer's confidential information; we will not use them for other customers or sell products made from them to third parties without written consent.

9. Confidentiality

Quotations, drawings, samples and technical documents shared between us are confidential. Each party will use them only for the purpose of the project and protect them with reasonable care.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising from an order is limited to the invoice value of the goods giving rise to the claim. We are not liable for indirect or consequential loss, including loss of profit, production stoppage, or penalties under a customer's own contract.

11. Governing law and disputes

These terms are governed by the laws of the People's Republic of China. The parties will first attempt to resolve disputes amicably; failing that, disputes are submitted to the competent court at our place of business in Guangzhou, Guangdong, China, unless a signed contract provides otherwise.
